  1. Types of Information that can be Collected

As it pertains to contractual agreements with CG SQUARED, CG SQUARED does not collect data or personally identifiable information of third parties under those contractual agreements. CG SQUARED is not a data company and it is not in the business of acquiring and/or selling any data of the parties it contracts with or the Users on its Site.

There are two types of information that can be collected: personally identifiable Information and non-personally identifiable information.

Personally Identifiable Information: This refers to information that identifies specifics of who you are. When you engage in certain activities on a website, such as registering for a membership, completing an application, putting information about your home online, submitting content and/or posting content and photographs of you home on a website, engaging in discussion forums or other public areas, entering a contest or sweepstakes, filling out a survey, or sending feedback, you may be asked to provide certain information about you. If you yourself are filling out and submitting an online form, it is completely optional for you to engage in these activities; however, disclosing your personal information, such as your first and last name, mailing address (including zip code), email address, employer, job title and department, telephone and facsimile numbers, home disclosure statements, and other personal identifying information is data that is personally identifiable.

Non-personally Identifiable Information: This refers to information that does not by itself identify a specific individual. This can include certain information about you based upon where you visit, purchase, and/or use of a website in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include a website’s Uniform Resource Locator (“URL”) that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol (“IP”) address.   1. No Collection and Use of Information

Aside from what you provide to enter into a formal contractual agreement with CG SQUARED, CG SQUARED, does not collect any additional forms of Personally Identifiable Information about you unless you voluntarily provide it to us to submit a request for information by contacting us through our Site and send email messages. Other than your own inquiries to CG SQUARED, CG SQUARED does not collect or process personally identifiable information of individuals.

In addition, we do not collect or store data or our third-party vendors and contracting parties. We do not use your IP address to diagnose problems with our servers, software, to administer our site and to gather demographic information. Our third-party application and NetSuite providers have servers that control the scope of data if the licenses offered by CG SQUARE are in use.

The CG SQUARED Services and its licenses do not involve collection of third-party data and information to have value or to operate.

  1. Release of Information

The limited Personally Identifiable Information that could be collected by us is solely from a submission request on our Site to contact a third party to discuss a potential contractual arrangement. We do not sell, trade, or rent your Personally Identifiable Information to others that you submit to CG SQUARED in this manner.

We will encourage our service partners to adopt and post their own individual privacy policies. However, as stated above, the use of your Personally Identifiable Information by our service partners is governed by the privacy policies of those service partners, and is not subject to our control.

Occasionally we may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. We will disclose Personally Identifiable Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

We may use Non-personally Identifiable Information about our customers’ sales, traffic patterns, and related site information to generate statistics, but those statistics do not include any Personally Identifiable Information and are anonymized analytics.

Google Analytics is a Google tool that we use for web analysis and allows companies to understand how Users engage with their website and other sites. Google Analytics may use cookies to collect non-personally identifiable information. Although the Website is accessible over the internet and therefore worldwide, the Site and Services are intended for residents of the United States only. CALIFORNIA PRIVACY RIGHTS; NEVADA RESIDENTS; RESIDENTS OF THE EUROPEAN UNION; AND ONLINE TRACKING

 

California Civil Code Section 1798.83 permits Users that are residents of California to request and obtain from us once a year, free of charge, a list of all third parties to which CG SQUARED has disclosed certain personally identifiable information as defined under California law for such third parties’ direct marketing purposes in the preceding calendar year.  If you are a California resident and would like to make such a request, please email us or write us at the address noted below. The California Online Privacy Protection Act (“CalOPPA”) requires CG SQUARED to disclose how it responds to ‘Do Not Track’ signals set in a user’s browser. CG SQUARED supports Do No Track browser settings.  If you enable Do Not Track privacy settings in the browser you are using, we will use commercially reasonable efforts to stop collecting the information that allows us to tailor the website to user preferences based on users’ recent use of this website and its services.  Consequently, we will not store or use information about any other websites you visit, other than our website.

 

However, please note that we are not required to erase or otherwise eliminate content or information if (i) other state or federal laws require us or a third party to maintain the content or information; (ii) the content or information was posted, stored, or republished by another user; (iii) the content or information is anonymized so that you cannot be individually identified; (iv) you do not follow the instructions posted in this Privacy Policy on how to request removal of your content or information; (v) you have received compensation or other consideration for providing the content. Further, nothing in this provision shall be construed to limit the authority of a law enforcement agency to obtain the applicable content or information.

 

Further, effective January 2020, for the purposes of the California Consumer Privacy Act of 2018 ("CCPA"), this statute was put into legal effect. CG SQUARED shall not be considered a Business and/or Third Party, as applicable under the CCPA at this time. Where this status changes and CG SQUARED acts as a Business and/or Third Party, you represent, warrant and covenant that all Personal Information provided or otherwise made available to CG SQUARED is done so in compliance with applicable law, and that it has provided all necessary and appropriate notices and opt-outs, and otherwise has all necessary and appropriate rights, to enable CG SQUARED to (i) share any and all Personal Information you provided with CG SQUARED and any parent, subsidiary, affiliate, or related company of CG SQUARED Group Companies, and (ii) use any such Personal Information in connection with CG SQUARED’s internal operations and functions, including, but not limited to, improving CG SQUARED’s services, operational analytics and reporting, internal financial reporting and analysis, audit functions and archival purposes. Notwithstanding the foregoing, the parties agree that the sharing of Personal Information between CG SQUARED and any of its subsidiary and affiliate entities does not constitute a "sale" of such Personal Information under the CCPA. Capitalized terms in this paragraph have the meanings given those terms under the CCPA.

 

  1. California Residents’ Privacy Rights

Under California Laws, California residents have the following rights (“Rights”) listed below. Your Right to Access and Right to Deletion are not absolute and are subject to certain exceptions. For instance, we cannot disclose specific pieces of Personally Identifiable Information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the Personally Identifiable Information, your account with us, or the security of the business’s systems of networks.

 

(I). Disclosure & Access Rights

California residents have the right to request that CG SQUARED disclose to them (i) the categories of Personally Identifiable Information we have collected about them, (ii) the categories of sources from which personal information is collected, (iii) the business or commercial purpose for the information collection, (iv) the categories of third parties with whom we have shared personal information, and (v) the specific pieces of personal information we hold about an individual.

 

(II). Deletion Rights

California consumers have the right to have their Personally Identifiable Information deleted, unless the Personal Information is necessary for the business or service provider to:

  • complete a transaction for which the Personal Information was collected, provide a good or service requested by the consumer or otherwise perform a contract between the business and the consumer;
  • detect security incidents;
  • protect against malicious, deceptive, fraudulent, or illegal activity (or prosecute those responsible);
  • debug to identify and repair functionality errors;
  • exercise or ensure the right of another to exercise free speech or another legal right;
  • comply with the California Electronic Communications Privacy Act, which compels the production of or access to electronic communication information or electronic device information with a search warrant;
  • engage in research in the public interest (if the consumer has provided informed consent);
  • to enable solely internal uses aligned with the consumer's expectations given their relationship with the business; comply with a legal obligation;
  • otherwise use the information internally in a lawful manner compatible with the context in which the consumer provided it.

 

(III). Opt-Out of Selling Your Personal Information to Third Parties

Californian consumers have the right to opt-out of having their personal information sold to third parties. CG SQUARED does not engage in such sales of personal information.

 

NEVADA RESIDENTS

Nevada law entitles you to request that we refrain from sale of your personal information to other entities, for purposes of resale. We do not engage in such sales of personal information.

 

RESIDENTS OF THE EUROPEAN UNION

Privacy and Electronic Communication (EC Directive) Regulations 2003, the General Data Protection Regulation 2016 ("GDPR"), the UK Data Protection Act of 2018 (“UK GDPR”) and all applicable laws and regulations that relate to the protection and processing of personal data and privacy including any guidance and code of practice issued by the United Kingdom's Information Commissioner, all as amended, replaced or superseded from time to time, shall be the controlling legal authorities for residents in the European Union that access the Site and Services. For clarity purposes, Personally Identifiable Information submitted and received by CG SQUARED in accordance with this Privacy Policy can triggering obligations under the foregoing statutes.

 

CG SQUARED shall comply with all applicable requirements under GDPR and the UK GDPR (as each is applicable), and shall process the Personally Identifiable Information only to the extent necessary for the purposes of performing its obligations under the Terms and Conditions and otherwise in accordance with the Site and Services’ documented instructions (including those set out in the herein) and, if CG SQUARED considers that any of your instructions infringe the applicable laws, CG SQUARED shall notify you promptly.

 

If CG SQUARED collects Personally Identifiable Information (Personal Data) under the GDPR from citizens of the European Union (Data Subjects) in connection with the provision of the Services it shall provide notice to the Data Subjects, compliant to legal transparency principles. CG SQUARED will only process data on an approved legal basis in accordance with the GDPR for citizens of the European Union and the UK GDPR for citizens of the United Kingdom. When consent is used as a legal basis it will be collected in such form as reasonably specified by CG SQUARED and acceptable to Data Subjects. CG SQUARED shall retain Personal Data for a minimum of 2 (two) years; provided, however, Data Subjects have the right to opt-out of having their personal information sold to third parties or to be retained by CG SQUARED. In cooperation with a Data Subject’s rights, Contractor shall, taking into account the nature of the processing, provide reasonable assistance to Data Subjects insofar as this is possible, to respond to requests from a Data Subject seeking to exercise their rights under the GDPR and the UK GDPR (as applicable) and the related data protection laws.  If such request is made directly to CG SQUARED, CG SQUARED shall notify Data Subject as soon as reasonably practicable, and in any event within 1 (one) to thirty (30) business days, of receiving any such request from a Data Subject.

 

RESIDENTS OF CANADA

All private-sector organizations that operate in Canada that collect, use, or disclose personal information in the course of a commercial activity and handle personal information that crosses provincial or national borders in the course of commercial activities, regardless of the province or territory in which they are based are subject to the Personal Information Protection and Electronic Documents Act (PIPEDA). CG SQUARED will obtain consent from the individual before collecting their personal information. Without the individual’s explicit consent, neither CG SQUARED cannot gather, store, or use anyone’s personal information. CG SQUARED shall only collect personal information for the purpose disclosed with consent. Upon receiving a request about the personal information of an individual, CG SQUARED has 30 days, with a possible 30-day extension (in its discretion) when reasonably necessary and by providing notice to the individual, for a total of 60 days about having their data, where it is stored, and the opportunity to opt out of CG SQUARED retaining such data. In case of a correction of incomplete or inaccurate personal information, upon such disclosure to CG SQUARED, CG SQUARED must update this change within 4 weeks. Upon such request, CG SQUARED shall immediately delete a particular individuals’ personal information from its records.

 

RESIDENTS OF AUSTRALIA

Upon CG SQUARED receiving any data submitted by individuals that identifies them personally, CG SQUARED will handle any “personal information”, as defined in the Australian Privacy Act 1988 as amended from time to time. The federal Privacy Act 1988 (“Privacy Act”) and the Australian Privacy Principles ("APPs") contained in the Privacy Act apply to private sector entities (including body corporates, partnerships, trusts and unincorporated associations) with an annual turnover of at least AU$3 million.

 

The Privacy Act regulates the handling of personal information by relevant entities and under the Privacy Act, the Privacy Commissioner has authority to conduct investigations, including own motion investigations, to enforce the Privacy Act and seek civil penalties for serious and egregious breaches or for repeated breaches of the APPs where an entity has failed to implement remedial efforts.

 

The Privacy Act also regulates consumer data rights, and allows a consumer to obtain certain data held about that consumer by a third party and require data to be given to accredited third parties for certain purposes. By requiring businesses to provide public access to information on specified products or services they have on offer, it is intended that consumers' ability to compare and switch between products and services will be improved, as well as encouraging competition between service providers, which could lead to better prices for customers and more innovative products and services. In this way, the consumer data right provisions of the Privacy Act provide a mechanism for accessing a broader range of information within designated sectors than is provided for by APP 12 in the Privacy Act, given it applies not only to data about individual consumers but also to business consumers and related products.

 

As a result of these regulations, if CG SQUARED collects personally identifiable information of data subjects in Australia in connection with the provision of the services and consumer purposes, it shall provide notice to all individuals that are compliant to legal transparency principles. Notice and an opportunity to opt out of CG SQUARED possessing and storing that data as set forth in the notice and opt out provisions in this Privacy Policy.

 

RESIDENTS OF NEW ZEALAND

New Zealand’s Privacy Act 2020 requires that the discloser must have a reasonable basis to believe that the personal information it discloses to CG SQUARED will still be covered by safeguards comparable to those in the New Zealand Privacy Act. CG SQUARED, if it receives personally identifiable information from a person, that data will be secured in accordance with applicable laws and storage security requirements. All such disclosures require a “lawful purpose” for collecting, using, holding or disclosing personal information. This lawful purpose must be connected with a function, or an activity of CG SQUARED is collecting the personal information, and the collection of information must be necessary for that purpose. Although New Zealand’s Privacy Act 2020 does not name specific legal bases for collecting, using or disclosing personal information. In accordance with applicable regulations, CG SQUARED requires that (subject to specified exceptions) the personal information must be collected directly from the individual concerned, and, in accordance with such regulations, the individual be made aware of the fact that the information is being collected, the purpose for which it is being collected, the intended recipients, the agency collecting and holding the information, as well as other specified details. These details must be provided prior to the collection of the personal information, or if that is not practicable, as soon as practicable afterwards. All such individuals will be given notice of receipt of their data, and the opportunity to opt out of CG SQUARED maintaining and possessing such data.

 

  1. Miscellaneous Privacy Issues

There is no age requirement to use the Site and Services. Company does not monitor the age of the Users. Users that are of the age of youth or teenagers under the age of 18 are encouraged to obtain the consent of their parent and/or guardian before using the Site and Services. Our policy is that we do not knowingly collect, use, process, or disclose any Personally Identifiable Information about visitors. You should also be aware that CG SQUARED does not require Personally Identifiable Information to be mandatorily disclosed. You may contact us through our website by sending email inquiries voluntarily and you therefore disclose your name, email address, etc. through the Site. If you engage information to third parties and notify third parties you did the same through our Site, such activities are beyond our control and this Privacy Policy does not apply to such information. Any submissions through this site are accepted with the understanding that they are private and not for any use but to analyze questions and inquiries. If you do not want your comments to be viewed, you are advised not to make any submissions. You agree that CG SQUARED may use your feedback, suggestions, or ideas in any way, including in future modifications of the Services, other products or services, advertising, or marketing materials but in an anonymized, de-identified manner for internal purposes, not for sharing or use with third parties. You grant CG SQUARED a perpetual, worldwide, fully transferable, sublicensable, non-revocable, fully paid-up, royalty free license to use the feedback you provide to CG SQUARED in any way.

As part of the signing documents of documents for transactions with CG SQUARED, we may require you to provide your electronic signature to certain forms or documents required by CG SQUARED or state/federal regulatory agencies. Required forms vary depending on your subscription, business, and/or location. Such forms will be made available to you if required. Your signature on these forms may be required to contract with CG SQUARED, which, failure to execute may prevent you from further contracting with CG SQUARED.
